Violating of any part of the Terms of Service will result in the discontinuation of your account.

 

1.Privacy Statement

We are committed to protecting your privacy. Billing information is stored securely with our service providers, Shopify, Chargebee, Stripe, Braintree, Paypal and Google. Only authorized employees within the company on a need to know basis shall use any information collected from Users. 2.Account Terms

You must be legal age in your geographic area to form a binding contract to use this Service.

You must provide your full legal name, a valid email address, and any other required information to complete the sign-up process.

 

You are responsible for maintaining the privacy and security of your account. Parasym will not be held liable for any damage or loss that may result from your failure to protect your login information, including your password. Parasym may communicate with you via email regarding your account, updates, or other issues related to your account. Parasym may refuse service to anyone for any reason at any time.

 

3. Payment and Access

We will charge you a fee based on your account plan, this will enable access to products and services. 

 

4. Your orders for Products

How we will accept your order request. Our acceptance of your order will take place when we send an email confirming our acceptance of your order to the email address you have provided to us, at which point a contract will come into existence between you and us.

4.1 If we cannot accept your order request. If we are unable to accept your order, we will inform you in writing and will not charge you for the Product. We may reject an order request for several reasons including but not limited to if the Product is unavailable, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the Product, because we are unable to meet a delivery deadline you have specified, because we do not believe that we can reasonably supply the product to you under the requirements we are obligated to adhere to by our regulators.

4.2 Your customer number. We will assign a customer number to your order and tell you what it is when we accept your order.

4.3 Products and Product packaging may vary slightly from pictures. The images of the Products and Product packaging displayed on our Platforms are for illustrative purposes only. We make every effort to display the colour, shape and size of Products and Product packaging accurately but we cannot guarantee that this will be reflected on the device through which you are browsing display. As such, your Product or Product packaging may vary to that shown.

 

 

5. Warranty and modifications to the Service and Fees

We shall ensure that at all points of time the standard of the Service remains high and maintains continuity. We may make changes or improvements to the Service at any time. We do not warrant that the Service will operate error-free.

PRODUCT WARRANTY INFORMATION

This product is warranted to be free from manufacturing defects for 2 years from date of purchase.

This warranty is void if  the product is modified or altered, is subject to misuse or abuse; damaged in transit; lack of responsible care; is dropped; if an incorrect battery has been fitted; if the unit has been immersed in water; if damage occurs by reason of failure to follow the  instruction or if product repairs are carried out without authority from Prasym Ltd.

 

Parasym reserves the right to modify, suspend, or discontinue the Service at any time for any reason with a notice period of 30 days.

 

Parasym reserves the right to change our monthly fees with 30-days notice. If fees are changed, notices will be posted to the Parasym website: https://www.Parasym.co. For existing contracts for which fees have been already paid and received, price revision would be implemented only during the next renewal and customers would be informed prior to this change via email.

 

6. Conduct of Users

You and any individual you allow access to the Parasym equipment, agree to not use our services, which include any devices or accessories we offer, in any way other than that stated in our safety and recommended usage parameters.

 

7. Cancellation and Termination

If your service involves an account, you alone are responsible for the proper cancellation of your account. Cancellation requests should be made through your online portal. You can cancel at any time, but you will remain liable for all charges accrued up to that time. If you have purchased our services for a one off fee, this will be the only charge of service. 

 

Parasym reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof); refuse any and all current and future use of the Service, suspend or terminate your account (any part thereof) or use of the Service and remove and discard any of Your content in the Service, for any reason, including, if Parasym believes that You have violated these TOS. Parasym will use all reasonable efforts to contact You directly via email to warn You prior to suspension or termination of Your account. Any suspected fraudulent, abusive, or illegal activity that may be grounds for termination of Your use of Service, may be referred to appropriate law enforcement authorities. Parasym shall not be liable to You or any third party for any modification, suspension or discontinuation of the Service.

 

8. Copyright and Ownership

Parasym Ltd or its suppliers own the intellectual property rights to any and all protectable components of the Service, including, but not limited to, the device and accessories provided, name of the Service, and the related documentation. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or disassemble any aspect of the Service which Parasym or its suppliers own.

 

Parasym Ltd claims no intellectual property rights over the Content you upload or provide to the Service. 

 

9. Support Services

Parasym liability is limited to the data stored in its own servers and does not extend coverage to the third party components and services.

 

10. General Conditions

You assume total responsibility and risk for your use of this Service. You agree not to resell, duplicate, reproduce or exploit any part of the Service without the express written permission of Parasym Ltd. Parasym, it’s affiliates and it’s sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service. Our aggregate liability in connection with any claim arising out of or relating to the website and/or the products, information, documents and services provided herein or hereby shall not exceed the fee paid by the User.

 

If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. The failure of Parasym to exercise any right provided for herein shall not be deemed a waiver of any right hereunder. The Terms of Service sets forth the entire understanding between You and Parasym as to the Service and supersedes any prior agreements between You and Parasym (including, but not limited to, prior versions of the Terms of Service).

You are responsible for complying with any applicable laws, rules, or regulations governing the export of the Service or any of its components.

 

12. Our rights to make changes

12.1 Minor changes to the Products. We may change the Products:

a. to reflect changes in relevant laws and regulatory requirements, including but not limited to compliance with the EU General Data Protection Regulation and any other applicable privacy and data protection laws; and

b. to implement minor technical adjustments and improvements, for example to improve the functionality of our Products. These changes may affect your use of the Product, which we will endeavour to tell you about in advance.

12.2 Significant changes to the Products and these terms. As stated in the description of the Products on our Platforms, we may make changes to the Product, but if we do so we will notify you and you may then contact us to end the contract before the changes take effect and receive a refund for any Products paid for but not received.

12.3 Product recall. The Parasym Device is registered as a medical device in the EU and other territories. It is registered in the EU as a MDD Class IIa product. As such, we are under an obligation to maintain procedures for identifying and tracing each unit, lot or batch of the Parasym Device and, where appropriate, components of the product. We are also under an obligation to establish and maintain procedures to control units of the Parasym Device that do not conform to specified requirements and may recall non-conforming units at any time where required by law or in our discretion.

13. Your health

We care about your health and all the information we provide is intended to help you make the best decisions about your own care and wellbeing. However no two customers are the same and advice that may be right for one user may not be right for another. There is no replacement for specialist medical advice from a qualified professional and we strongly recommend you seek such advice before using our products or services, or relying on the information provided via our platforms. This is particularly important if you have any known pre-existing conditions.

 

By agreeing to these terms you agree that you will seek specialist medical advice from a qualified professionals before using our products and services and before relying on information provided via our Platform.

 

Products must only be used as intended in line with instructions for use. 

 

Parasym Ltd are not responsible for any adverse effects as a result of misuse of the device. When operating the device, the Parasym instructions for proper use should be followed. Parasym Ltd is not responsible for misuse of the device or supporting materials. If you experience adverse side effects and are concerned please contact the Parasym team or your physician.

We are constantly updating and improving the content provided via our Platforms. As such, it is possible that the products or information provided to you via our Platforms may be unavailable, not as described or otherwise inaccurate. In the event that a court of competent jurisdiction holds any provision of this Terms and Conditions to be invalid, such holding shall have no effect on the remaining provisions of this Terms and Conditions and they shall continue in full force and effect.

You acknowledge that you have not relied on any statement, promise, representation, assurance or warranty made or given by or on behalf of us which is not set out in these Terms and Conditions and that you shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in these Terms and Conditions.

 

19. Governing Law

These Terms of Service shall be governed by the laws of the United Kingdom without regard to the principles of conflicts of law. You hereby expressly agree to submit to the exclusive personal jurisdiction of the United Kingdom for the purpose of resolving any dispute relating to Your access to or use of the Service.

Purchase of products for research purposes. If you have purchased products for research purposes you agree to adhere to the latest version of Parasym’s research terms available here.

21. Indemnity

You agree to indemnify and hold us, our officers, directors, employees, licensors and other connected persons harmless from any claim, proceedings or demand made by a third party due to, or arising as a result of, a violation by you of our terms and conditions (including our privacy policy and terms of service), or any applicable laws, regulations or third party rights.

21.1 We may transfer this agreement to someone else. Subject to the terms of the Privacy Policy, we may transfer our rights and obligations under these terms to another organisation.

21.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person or entity if we agree to this in writing.

21.3 Nobody else has any rights under this contract (except someone you pass your guarantee on to). This contract is between you and us. No other person shall have any rights to enforce any of its terms.

21.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

21.5 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
